  • Check list for allotment /Settlement of land

    Allotment/Settlement of Government land to individual person, institutions, NGO, different Government Agencies, Educational Institutions etc.are governed by various provisions of Land Laws, Rules,Government Instructions etc. It will be convenient for all concerned including the Government Officials to consult the check list while applying, preparing or forwarding such proposals to the competant authority.

    Check list for allotment /Settlement of land for individual

    • Petition of the petitioner.(Prescribed format)
    • Court Fee whether properly affixed as per Court fee Act.
    • Affidavit in prescribed format.
    • Photo copies of revenue(Bedakhali Jarimona/Tozi Bahira) paying receipts (old and current)
    • Present Address of the Petitioner.
    • Original Address of the petitioner.
    • Whether landless, if so how.
    • Landed property of the petitioner and his family (if any) within the State.
    • Whether citizen of India,if so how.
    • Occupation of the petitioner.
    • Period of possession specifying the nature of possession.
    • Report of LR Staff.
    • Two copies of Chitha of the proposed land.
    • Two copies of trace map of the proposed land.
    • Provision of road/drain whether kept while preparing the proposal.
    • Whether the proposed land falls under VGR/PGR/Wet land/ CS land/Khas Govt.land/NR.Govt.land/reserved for Govt.Departments/Ancient Monuments/Reserved for other purposes.
    • Whether the proposed land falls within 10 K.M radius from the periphery of GMDA /GMC or Within the periphery of 3KM from other MTs/ MBs of the state.
    • Whether the roadside/riverside land (if any)is reserved as per provisions of Land Policy, 1989 and Rule under the ALRR,1886.
    • Specific View/Comment of Circle Officer/SDO(C)/ADC/DC with recommendation and signature.
    • Zonal/ Current valuation report of the proposed land whichever is higher.
    • Status report of the proposed land as per Village Land Bank.
    • Whether the petitioner is Disable/SC/ST/OBC/Ex-Servicemen/Others/Widow
    • SDLAC Recommendation.

    The following points should be checked for Kamrup (M) and adjoining hill areas in addition to the above points:

    • Photograph of the house.
    • Length of Possession-Electricity Bill/Telephone Bill/Copy of Voter List/GMC Tax Payment receipt should be produced.
    • Total area occupied.
    • Provision of Road,drain and other safety condition.
    • Whether the proposed land is under Wild Life Sanctury, Reserve Forest, Notified Forest,Proposed Reserve Forest/Unclassified forest or any land barred for allotment/settlement by a judicial pronouncement or any Central or State Legislation.
    • Whether the proposed land is Wet land or alloted/reserved for a Government or a public institution.
    • Whether the proposed land is Safe for habitation.
    • The allottee or their forefather must be in the Voter's list of 1971 or before.
    • Affidavit as per Model Affidavit.

    • Requiring Department's Petition /request letter.
    • Two copies of Chitha of the proposed land.
    • Two copies of trace map of the proposed land.
    • Report of LR Staff.
    • Specific view of Circle Officer/ADC/DC.
    • Essentiallity report/Inspection Report in respect of educational institution.
    • Report as per Right to education Act-2009 for educational institution.
    • Whether the proposed land is outside roadside/riverside reservation.
    • Provision of road/drain.
    • Whether the proposed land falls under VGR/PGR/Wet land/ CS land/Khas Govt.land/NR.Govt.land/reserved for Govt. Departments/Ancient Monuments/Reserved for other purposes.
    • Whether the proposed land falls within 10 K.M radius from the periphery of GMDA /GMC or Within the periphery of 3KM from other MTs/ MBs of the state.
    • period of possession specifying the nature of possession.

    • Whether there are valuable trees/minerals on the land.
    • Whether the proposed land falls under Tribal Belt/ Block.
    • Whether the proposed land is under Wild Life Sanctury, Reserve Forest, Notified Forest,Proposed Reserve Forest/Unclassified forest or any land barred for allotment/settlemnt by a judicial pronouncement or any Central or State Legislation.
    • Why the institution/organization should not arrange land for its use on its own.
    • Protection of Village Common Lands, Particularly VGR and PGR.
    • Avaiability of land as per Village Land Bank.
    • SDLAC recommendation.

    • Why is the Organization is formed ?
    • Activity for the last Three years.
    • Balance Sheet (Audit report)Total Bank Balance and last three years audited account of the applicant NGO.
    • Why so much land is necessary- Justification.
    • Whether the NGO is registered under the Societies Registration Act,1860 or under the Assam Cooperative Societies Act,1949.
    • Names of the Board of Directors and Members of office bearers of the organisation.
    • The present profession of the members of the NGO.
    • Actual assessment of the requirement of land.
    • Valid Registration Certificate.

    • Time frame for execution of the project.
    • Source of funding.
    • Two copies of Chitha of the proposed land.
    • Two copies of trace map of the proposed land.

    4. RSS.1429/2006/2 dtd 17-11-20061.The allotee or their forefather must be in the voter's list of 1971 or before.

    1. Affidavit as per Model Affidavit.

    2.No settlement proposal in respect of Guwahati /other towns of the State should be

    submitted to Govt. in favour of any petitioner who own land in his/her name /spouse's name

    /in the name of his/her family member any where in the state.

     
    6.RSS 1094/2005/10 dtd 19-2-2007Matric system of measurement of land should be used.

    War widow/erosion affected/Ex Servicemen/Retired armed forces personnel

    2.Area to be alloted/settled in town area should not exceed 4.00 ares in

    Municipal Corporation area and 5.50 ares in other towns and in rural area it should not exceed one Bigha for homestead purpose.

    Judgementsin Civil Appeal No.1132 of 2011 &SLP © No-3109 of 2011 dated 28-01-2011(Jagpal Singh &Ors- Vs-State of Panjab &Others.)

    1. Status report as per Village Land bank.

    2.No PGR/ VGR land should be settled with anyone except for community purposes in exceptional cases e.g. where lease has been granted under Some Govt. Notification to landless labourers or members of Scheduled Castes/ Sheduled Tribes or where there is already a school, dispensary or other public utility on the land.

    3.In no case should the area under VGR/PGR be reduced to less than 5% of the total Village land area.

    10.RSS 1656/2013/11 dtd 24-12-2013

    1.(a) Recommendation of Hon'ble CM is required for allotment/settlement of land upto 2 Katha for homestead purpose in Guwahati Metropolitan area/ within 10K.M. Radius from boundary of GMC..

    1.(b) Approval of the Cabinet is required for land above 2 Kathas in respect of categories mentioned above.

    2.Approval of the Hon'ble Minister, Revenue &DM is required for allotment/settlement of land up to 2 Kathas for residential purpose in other towns/ 3 K.M radius from boundary of town in the state.
     
    3.Approval of the Cabinet is required for allotment/settlement of Govt. land falling under Guwahati Metropolitan area / 10 K.M. Radius from the boundary of GMC/ 3 K.M, radius   from boundary of other towns in the state for purposes other than residential in case of individual/ Private organizations/ Companies/Societies/NGO etc

    4.As per RTE act,2009 schools up to Elementary Level can be established/allowed to function after three years of the Act coming in to force only if they meet the norms laid down by the Act.

    5.Measures for environmental safeguards/greening plan/solid an hazardous wastes disposal facility/effluent management system/air and water quality monitoring machanism/ community action plan for protection of natural and human habitates in the adjoining area are to be ensured while considering/submitting for industrial unit.

    1.Policy regarding regularization/removal of unauthorised construction of places of religious nature on Govt. land, public streets,parks or other public places etc should be followed.

    2.District wise list of religious structure in existence prior to the issue of the policy is to be placed before a committee headed by the Chief secretary to  review on case to case basis.

    1.Approval of the Cabinet is required for allotment/settlement of Govt. land falling under Guwahati Metropolitan area / 10 K.M. Radius from the boundary of GMC/ 3 K.M. radius   from boundary of other towns in the state for purposes other than residential in case of individual/ Private organizations/ Companies/Societies/NGO etc.

    2.No cabinet approval is required for allotment/settlement of land for infrastructural projects of the State/Central Govt.

    3.Cabinet approval is required for allotment/settlement of Govt. land in the state including Guwahati in favour of individuals,private organizations,companies, societies etc. would be cleared only after approval of the cabinet.
